Article 1 (Purpose)
The purpose of this Terms and Conditions is to prescribe matters concerning the conditions and procedures for the use of various information services (hereinafter referred to as "service") provided by the Korea International Culture Association (hereinafter referred to as the "KICA") and other necessary matters.
Article 2 (Application of Terms and Conditions)
These terms and conditions apply to the procedures and other necessary matters for the use of all services provided by the KICA on the Internet.
Article 3 (Definitions of Terms and conditions)
- ① The term “service” refers to the KICA's homepage service on the Internet.
- ② The term "member" means a person who agrees to this terms and conditions and provides services on the Internet site operated by the KICA by setting the ‘id’ and ‘password’ required for service use.
- ③ term "membership information" refers to the members' personal information requested by the KICA, such as their name, resident registration number, contact information, etc. which are requested to be recorded on the online application form.
- ④ The term "id" refers to the recognition character set by the member himself/herself for the identification of the member and the service use of the member, and written in English, numerals, English and numeric combinations of having at least four digits and not more than 15 digits approved by the KICA

⑤ The term "password" means a cryptographic character that is set by the member himself/herself for the confidentiality of the member and security of various information provided to the service, and is written in English, numerals, English and numeric combinations of having at least four digits and not more than 15 digits approved by the KICA. If the password is used using the following combination or similar principle, the possibility of theft is very high and should be avoided.
- 1. If password is the same as id
- 2. If 4 or more digits match continuously in the resident registration number,, home phone number, or mobile phone number
- 3. If the same character is used three consecutive digits
Article 4 (Types of Services)
Article 5 (Constructions of a contract using the service)
- ① A service contract is established when a person who intends to become a member agrees to this terms and conditions and prepares member information (id, password, name, resident registration number, phone number, other matters recognized by the KICA) on the prescribed subscription form, and the KICA approves this contract.
- ② A member shall faithfully provide personal information required by the KICA.
- ③ The KICA receives ID and password and manages them.
- ④ This terms and conditions shall be effective by posting it on KICA's website (www.kicaworld.or.kr) or otherwise notifying the member.
- ⑤ If the member does not agree to the changed terms and conditions, the service use may be discontinued and the member may withdraw (disengage).The KICA will notify the member individually of the changes in terms and conditions in advance, and if the member agree or if the member do not express their opinions after confirming their consent through the notice on the website, they will be deemed to have agreed to the changed terms.
- ⑥ The members shall fulfill his/her duty of care for the change of the terms and conditions. Due to the site of the amended terms and conditions, members applying for service use under these terms and conditions are deemed to have agreed to comply with KICA's frequent announcements. This is because the KICA needs to comply with various policies and services, including the collection, use, and KICA's ”Privacy Policy” for the purpose of copyright protection, and “Copyright Policy” under the terms and conditions.
Article 6 (Protecting Member Information)
- ① The KICA limits the number of managers to a minimum to protect member’s personal information.
- ② The KICA strives to protect personal information including member information as provided by relevant statutes. The member's personal information protection shall be governed by the relevant statutes and KICA's "Personal Information Protection Policy" separately posted up.
Article 7 [Changing Member Information]
- ① The member can view and modify his or her personal information anytime through My Page. However, the real name, resident registration number and ID required for service management cannot be modified.
- ② When a member applies for membership registration, he/she shall revise it online or inform "KICA" of the change by e-mail or other means.
- ③ According to this item, 'KICA' is not responsible for any disadvantages caused by not notifying 'KICA'.
Article 8 (Duties of Member)

① A member shall not perform any of the following acts when using the service:
- 1. The act of improperly using id and password of other members
- 2. The information obtained by using the service is not used personally by the member as well as the act of duplicating, performing, broadcasting, exhibiting, distributing, publishing, etc. through copying, processing, translation, secondary works, etc. and the act of providing them to third parties
- 3. The act of damaging or penalizing others
- 4. The act of violating copyrights of the KICA, copyrights of third parties, and other rights
- 5. The act of disseminating information, sentences, shapes, and voices that violate public order and customs to others
- 6. The Act objectively recognized as being linked to crime
- 7. The act of registration or dissemination of computer virus infection data in order to cause malfunctions or confusion in service-related equipment
- 8. The act of transmitting information that may interfere with the stable operation of the service or thatof sending advertising information against the will of the recipient
- 9. The act of violating other relevant statutes
- ② All responsibilities regarding the management of id and password belong to the member himself.The id and password granted to the member shall not be lent or transferred to a third party or engaged in any similar act;The member himself shall be responsible for all consequences caused by improper use and management of id and password.
- ③ A member shall immediately change their password and notify the KICA of the fact if their id is used unfairly.
- ④ When a member's personal information is changed, he/she shall revise it through the Internet or notify the KICA without delay.
- ⑤ A member shall faithfully comply with the matters stipulated in these terms and conditions and the relevant statutes, as well as the service information or precautions.
- ⑥ The members shall comply with the usage restrictions posted on the service notice for each content or announced separately by the KICA.
- ⑦ A member shall not transfer or donate his/her service right or other service contract status to another person without prior consent from the KICA, nor shall he/she provide it as collateral.
- ⑧ A member must register with his or her real name, and if he or she steals someone else's name, he or she cannot receive any protection and can be punished according to the relevant laws and regulations.
Article 9 [Notice of Member]
- ① When the KICA notifies a member, it can be done by e-mail of the member unless otherwise stipulated in this terms and condition.
- ② the KICA will implement the notice under this article by posting it on the bulletin board of " KICA" for more than seven days for notification to all its members.
Article 10 (Transfer of right to use services, etc.)
- ① Without prior consent from the KICA, the authority to use the service and other service contract status cannot be transferred or donated to others.And this cannot be provided as collateral.
- ② The KICA may request change of id of its member through notice for reasons such as security, ID policy, and smooth provision of services.If the member does not comply with KICA's request, the service use may be suspended until the member's id is changed.
- ③ The KICA can change id for member who have not changed id according to this article. In this case, the KICA shall notify the relevant member about the change of id within 7 days via mobile phone text or e-mail.
Article 11 (Cancellation and Use Restriction)
- ① The KICA accepts the service use according to the order of receipt for the customer who applied for the service use. If a member intends to terminate the service contract, he/she shall apply for termination to the KICA through using the KICA website or a separate method set by the KICA. In this case, the KICA will delete the information of the member who has requested the termination through a prescribed revocation procedure

② If an application for service use is deemed to fall under any of the following, or the status of use after the application for service use is deemed to be one of the following, the KICA may refuse to accept the service use or restrict the use and withdraw the service.
- 1. In the case of divulging member-specific information such as id and password to another person, or stealing other person's id and password
- 2. In case of intentionally obstructing the operation of the service
- 3. If the name you have subscribed to is not your real name
- 4. If the same user has double-registered with a different id
- 5. In case of intentionally disseminating content that is detrimental to public order and customs
- 6. In case of planning or implementing service use, for the purpose of undermining the national or social interests of the member
- 7. In case of an act that damages or penalizes another person's reputation
- 8. In case of sending information or advertising information for the purpose of obstructing the stable operation of the service
- 9. In case of distributing computer virus programs, etc. to cause malfunctions or destruction of information in communication facilities.
- 10. In case of violating the KICA, other members or intellectual property rights of third parties
- 11. In case of replicating information obtained by using KICA's service information without prior consent from the KICA, or distributing it or using it commercially
- 12. In the case of posting obscene materials on bulletin boards, etc. or connecting (link) pornographic websites
- 13. In violation of the terms and conditions of use and related statutes prescribed by the KICA, including the terms and conditions of service use, if it is deemed difficult to provide services anymore
- 14. In case of bullying other users, such as stalking
- 15. In case the member information specified in the application form of the KICA is insufficient
- 16. In case it is deemed that a service application has been made for criminal purposes
- 17. In case you are deemed to have subscribed to the service for the purpose of pursuing profit
- 18. In case, it is deemed by the administrator to be detrimental to the operation of the website, if a customer who has already withdrawn is re-joined
- 19. In case there is a possibility that the posting of subjective articles will negatively affect other members
- 20. In case of any other breach of all obligations under this Agreement
- 21. In case there is any possibility or doubt about the spread of the virus, and it is deemed that he/she has joined for the purpose of posting advertisement information
- ③ A member who has committed an act falling under paragraph 2 of this Article shall be responsible for any damages incurred to the KICA or other members.
- ④ A member may file an objection to the KICA measures referred to in paragraph 2 of this Article in accordance with the procedures set by the KICA, and if the objection is deemed justifiable, the KICA resumes the use of the service.
Article 12 (Management of publications, etc.)

① The KICA may delete all contents of the service posted or delivered by the member (including the contents delivered between members) without prior notice if it is deemed to be the following cases
- 1. In case of slander or slander against another member or a third party, thereby damaging his or her reputation
- 2. In case of violation of public order and customs
- 3. In case it is deemed to be related to a criminal act
- 4. In case of infringing other rights, such as copyrights of the KICA, copyrights of third parties, etc
- 5. In case the posting period specified by the KICA is exceeded through the detailed instructions for use prescribed in paragraph (2) of this article
- 6. In case it is deemed to be in violation of other relevant statutes, detailed guidelines of the KICA, etc
- ② The KICA may separately establish and implement detailed instructions related to the post, and a member shall register/delete various posts (including the contents delivered among the members) in accordance with the guidelines.
- ③ The KICA shall have full authority to modify/delete postings, etc. falling under paragraph 1 of this Article, but shall not modify/delete the contents without notice to the members.
- ④ A member shall not request the KICA to upload additional postings for personal interest
Article 13 (Responsibility to Link Sites)
- ① The KICA may provide a member with links to other corporate websites or materials. In this case, since the KICA has no control over external sites and data, it cannot guarantee or be liable for usefulness and its accuracy of the services or data provided by the KICA. And here KICA's Privacy Policy is also not applied.
- ② A member shall trust the services or data of the linked external site.And he or she shall acknowledge and agree that the KICA is not responsible for any damages or losses incurred in connection with these matters
Article 14 (Liability exemption)
The KICA shall not be responsible for any damages incurred to a member due to any of the following reasons: However, this is not the case if there is a significant causal relationship that is deemed responsible by the KICA.
- ① In case the service is not provided or delayed due to unavoidable circumstances, such as a breakdown in communication devices, lines, and computers, or a flood of transactions
- ② In case a member leaks ID, password, etc. to a third party due to one's own neglect of management
- ③ In the case of a member's computer manipulation or error in the handling of his/her duties, etc.
- ④ In case of other natural disasters, etc. due to unavoidable reasons
Article 15 (Attribution of copyright and Restriction of use)
- ① Copyright and other intellectual property rights relating to web screens (phrases and designs) created by the KICA are vested in the KICA.
- ② A member shall not distribute information obtained by using the services provided by the KICA through publication, reproduction, broadcasting, or other means without prior consent from the KICA, or allow third parties to use it.
Article 16 (Efficiency and Change of Terms and Conditions)
- ① The KICA may change these terms and conditions if reasonable reasons arise. In this case, the date of application and revision shall be notified through the initializing screen or the connection screen from 7 days before the date of application to the day before the date of application date.
- ② When the terms and conditions of use are changed, the KICA shall notify all the member individually in advance of the change of the terms and conditions, and the members shall seek their consent or announce the change of the terms and conditions seven days prior to the change through the notice on the website. After that, the KICA must confirm the consent of the members, and if the members do not express their opinions, they shall be deemed to have agreed to the changed terms and conditions.
- ③ Any member who has an objection to the changed terms and conditions may withdraw as prescribed in this terms and conditions, and the service use after the effective date of the terms and conditions shall be subject to the changed terms and conditions.
Article 17 (Responsibility for Violating the Terms and Conditions)
The KICA and its members shall separately bear all the responsibilities arising from the breach of these terms and conditions respectively. If the other party suffers damage due to this, the other party shall be compensated without delay.
Article 18 [Liability exemption]
- ① The KICA shall not be held liable if a member fails to use the service due to reasons attributable to the member.
- ② The KICA shall not be responsible for the authenticity, reliability, and accuracy of the data posted or transmitted by a member and all data that the member can receive from the service.
- ③ The KICA shall not be responsible for any damages arising from the transaction of goods through the service between its members
- ④ The KICA is not involved in any disputes between its members without any cause attributable to the KICA.
- ⑤ The KICA shall not be responsible for any damage caused by the member's negligence in the management, inspection, repair, or replacement of the server or the software works, whether intentionally or unintentionally. The examples include: A system failure, a system failure due to third-party attacks. And it is a force majeure reason that the KICA cannot control the distribution of computer viruses, etc. where countermeasures have not been developed by prominent domestic and foreign research institutes or security-related companies.
- ⑥ The damage to the member referred to in paragraph 5 is due to (1) Economic and mental damages caused by damage or loss of data (hereinafter referred to as "damage or loss of data") posted, transmitted, or stored by a member using this service and (2) The damages or losses of such data include the economic and mental damages that may occur to the member due to the inability or delay of the member's actual acts or other legal actions to be performed using this service. It is not limited to this.
- ⑦ Notwithstanding paragraphs 5 and 6, the KICA shall not be held liable for damages of the member caused by the KICA without intentional or gross negligence in connection with the use of services provided by the KICA
Article 19 [Member's Post]

① The KICA may delete, move, or refuse registration without prior notice if it determines that the posts in the service posted or registered by a member fall under any of the following;
- 1. In case of slander or slander against another member or a third party, thereby damaging his or her reputation.
- 2. In case of violation of public order and customs.
- 3. In case it is deemed to be related to a criminal act.
- 4. In case of infringing other rights, such as copyrights of the KICA, copyrights of third parties, etc.
- 5. In case of posts deemed to be in violation of KICA's guidelines.
- 6. In case of Linking or posting pornographic material or pornographic site (including posting of pornographic content).
- 7. In case the same or similar content is repeatedly posted.
- 8. In case the content is not appropriate to post, or it is deemed to undermine a healthy debate culture.
- 9. In case the post is an insult to the KICA or to a certain person, or it is something that defames them.
- 10. In case it is deemed to be in violation of other relevant statutes.
- ② In case the reasons for the restriction on the registration of posts prescribed by the terms and conditions are violated in addition to the reasons specified in the preceding paragraph of this Article, the KICA shall apply all the provisions.
Article 20 [Stop Service]
- ① The KICA may temporarily suspend the service due to unavoidable reasons such as urgent system inspection, extension, and replacement, and may completely suspend the service provided for reasons such as the replacement of new service, etc.
- ② The KICA may restrict or suspend all or part of the service if normal service provision is not possible without any cause attributable to the KICA, such as failure of the service facilities or excessive use of the service, etc.
However, in this case, the reason and the period are notified to all the members in advance or after the event.
- ③ The KICA may suspend its service in the event of a force majeure, such as a natural disaster or war. Alternatively, if the telecommunication business operator, etc. stops telecommunication services or does not provide telecommunication services normally, the service can be stopped.
Article 21 [Providing Information]
- ① The KICA may send (or provide) various information and advertisements to members through e-mail or letter mail that are deemed necessary to use the service.
- ② The KICA may request additional personal information with the consent of the members for the purpose of improving the service and introducing the service to the members
Article 22 [Dispute Mediation and Jurisdiction Court]
- ① In case of a dispute concerning member information, to resolve disputes quickly and effectively, the KICA and its member can apply for dispute mediation to the Personal Information Dispute Mediation Committee established under the provisions of the Act on Promotion of Information and Communications Network Utilization and Information Protection.
- ② In case of a lawsuit regarding a dispute arising from the use of the service, the competent court located at the original location of the provider shall be the exclusive jurisdiction
[Transitional Regulations] ① These terms and conditions shall apply as of November 1, 2020.
